Terms and Conditions
To ensure the best experience for all of our guests, we kindly ask that all bookings review our terms and conditions before confirming their reservation.
Definitions: In these terms, the following can be defined as:
Premises: Means the Captured Media Studio photography studio, including all studio areas, cyclorama, fixtures, fittings, equipment, storage areas, bathrooms, entryways, car parking areas, common areas, and any other areas made available to the Client as part of the booking.
Equipment: Means all furniture, props, lighting equipment, backdrops, décor, accessories, styling items, studio equipment, and any other items owned, supplied, or made available by Captured Media Studio for use during the hire period.
Client: Means the individual, business, company, organisation, or other entity making the booking and includes any person acting on their behalf.
Guests/Personnel: Means any employee, contractor, subcontractor, client, customer, model, performer, attendee, invitee, representative, agent, assistant, volunteer, family member, child, or other person attending or accessing the Premises in connection with the Client's booking.
Cancellations/Reschedules: Cancellations within 48 hours of the booking time will be charged the full fee. Reschedules within 48 hours of the booking time will be charged a 50% of the total hire fee. All reschedules are subject to availability.
Session Booking: All booking times include setup, pack down, cleaning and departure time. The Client agrees that they are required to leave the premises upon the conclusion of the prearranged time slot. Captured Media Studio reserves the right to decline any booking request at its discretion.
Overtime: If the hire exceeds the agreed time, a fee of $150 per hour will apply (rounded up to the nearest hour). However, if there is a booking following your scheduled session, you will be required to leave upon the conclusion of your prearranged time slot.
Prohibited Items: The following items are strictly prohibited from the premises:
Smoking
Vaping
Illegal substances
Open flames
Glitter
Smoke machines
Powders
Oils
Wax
Paint
Hazardous materials
All other items that may cause excessive mess must be approved by Captured Media Studio at time of booking.
Condition: The studio will be inspected before and after the hire.
Client Responsibility: The Client is liable for any damage to the premises, cyclorama, furniture, or equipment caused by the Client, their personnel or their guests. It is expected that the Client will remove all rubbish, tidy bathrooms, return furniture and generally restore the Studio by the end of the session time.
Breakage Fees: Any damage will be charged at the full replacement or repair cost. This includes professional cleaning fees if the studio or it's contents are left in an unreasonable state.
Equipment/Furniture: All equipment and furniture belonging to Captured Media Studio is strictly prohibited from leaving the premises under any circumstance. All equipment is used entirely at your own risk.
Cyclorama: Any excessive wear to the cyclorama will incur a minimum repainting fee of $200.
Notification of Damage: The Client must immediately report any damage, fault, spill or hazard. Clients must not attempt to repair any damage.
Capacity Limits: The maximum capacity limit of 10 persons must be complied with unless otherwise approved by Captured Media Studio.
Children/Minors: All persons under the age of 18 must be supervised at all times.
Assumption of Risk: The Client acknowledges that the use of photography studios, its backdrops and other equipment contain inherent risks and accepts responsibility for those risks.
Payment Terms: Any overtime fees, cleaning charges, repair costs, replacement costs, damage fees, or other charges arising from the Client’s use of the studio may be invoiced following the booking and are payable within seven (7) days of the invoice date. The Client agrees to reimburse Captured Media Studio for any reasonable costs incurred in recovering overdue amounts, including debt collection fees, legal costs, and administrative expenses.
Lost Property: Captured Media Studio will attempt to return any property found following a booked session to the Client. Any items that are left behind for more than 14 days may be disposed of.
Social Media / Copyright: Captured Media Studio grants the Client permission to photograph/video the entire premises and to repost tagged content. The Client grants Captured Media Studio permission to repost tagged content and photograph/video the space in use for their own advertisement, which may or may not include the Client, their personnel or their guests.
Studio Insurance: Captured Media Studio maintains Public Liability Insurance; however, this does not cover the Client’s equipment, staff, or third-party contractors.
Client Insurance: The Client must hold their own Public Liability Insurance (minimum $10 million recommended) and, where applicable, Professional Indemnity Insurance.
Proof of Coverage: We reserve the right to request a Certificate of Currency prior to the commencement of the hire.
WHS Compliance: The Client must comply with the Work Health and Safety Act 2011 (NSW). This includes maintaining clear fire exits and ensuring all electrical equipment brought onsite is tested and tagged.
Behaviour & Removal Rights: Captured Media Studio reserves the right to refuse entry to any persons presenting as intoxicated, abusive or otherwise acting improper. Any Clients, their personnel or guests may be removed from the premises if acting in such a manner.
Music/Noise: The Client agrees to comply with the local council's noise level requirements and respect all neighbours in the complex.
Liability: The Client agrees to indemnify Captured Media Studio against all loss, damage, or injury suffered by any person arising out of the Client’s use of the studio, except where such loss is caused by the gross negligence of the Studio.
Limitation of Liability: To the maximum extent permitted by law, Captured Media Studio's liability is limited to the amount paid for the booking.
Force Majeure: Captured Media Studio is not liable for any failure to provide the studio due to circumstances beyond our control (e.g., power outages, government-mandated lockdowns, or building emergencies).
CCTV Disclosure: Captured Media Studio may operate CCTV or other security monitoring systems in entryways, common areas, external areas, and other non-private sections of the premises for security, safety, operational, insurance, and incident reporting purposes. By entering the premises, the Client and their guests acknowledge and consent to such monitoring where permitted by law. CCTV monitoring will not be conducted in private areas such as bathrooms or change rooms. The Client must not interfere with, obstruct, disable, move, or tamper with any CCTV cameras, security systems, alarms, locks, or access control devices.
Privacy Statement: Captured Media Studio may collect personal information including names, contact details, booking information, identification details, and payment information for the purposes of processing bookings, providing studio services, communicating with clients, maintaining security, complying with legal obligations, and managing the operation of the business. Personal information will be handled in accordance with applicable Australian privacy laws and will only be used for legitimate business purposes. Captured Media Studio will not sell personal information to third parties. Information may be disclosed where required by law, to insurers, legal advisers, debt recovery agencies, payment processors, or service providers assisting in the operation of the business. Clients may request access to, or correction of, their personal information by contacting Captured Media Studio.
